Acceptable Use Policy

Policy Overview
This Acceptable Use Policy ("AUP") describes prohibited uses of Malya's services. Violations may result in immediate suspension or termination of your account, without refund. This AUP supplements our Terms of Service and applies to all Malya products and services.
1. General Prohibitions
You may not use any Malya service to:
- Violate any applicable federal, state, local, or international law or regulation
- Infringe upon the intellectual property rights of others
- Transmit or store malicious software, viruses, worms, ransomware, or any code designed to damage or disrupt systems
- Attempt unauthorized access to Malya systems, other accounts, or third-party networks
- Conduct denial-of-service or distributed denial-of-service (DDoS) attacks
- Engage in scraping, crawling, or data mining of our platform without written permission
- Circumvent usage limits, metering, or access controls
- Resell, sublicense, or white-label Malya services without an explicit reseller agreement
2. Voice Receptionist (Malya Voice) — Specific Rules
- No spam or robocalling: You may not use Malya Voice to initiate unsolicited outbound calls or messages in violation of the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any applicable telemarketing law.
- Caller disclosure: You must ensure that callers are informed that they are interacting with an AI system where required by law.
- No impersonation of emergency services: You may not configure Malya Voice to impersonate 911, law enforcement, government agencies, or healthcare providers.
- Call recording compliance: You are solely responsible for ensuring your use of call recording complies with applicable wiretapping and consent laws in all jurisdictions where your callers are located (including all-party consent states).
- No deceptive practices: You may not configure AI agents to mislead callers about the nature of their interaction or to collect information through deception.
- Age-restricted content: You may not use Malya Voice to collect information from callers under 13 years old or to deliver age-restricted content without appropriate verification.
3. Data Infrastructure & AI Services — Specific Rules
- Data you provide must be lawfully obtained: All data submitted for processing, model training, or database infrastructure must be data you have the legal right to use. Do not upload data obtained through unauthorized means.
- No training on protected classes: You may not use Malya AI development services to build models that discriminate based on race, color, religion, sex, national origin, disability, or other protected characteristics.
- Credential security: You are responsible for safeguarding any API keys, database credentials, or access tokens you share with Malya during project engagements. Rotate credentials promptly after engagement completion.
- No weapons or harmful AI: You may not engage Malya to build AI systems designed to cause physical harm, generate CSAM, or enable mass surveillance without legal authority.
4. Content Standards
You may not store, transmit, or instruct Malya AI to generate content that is:
- Defamatory, harassing, threatening, or abusive toward any individual or group
- Obscene, sexually explicit, or involving minors
- Designed to incite violence or terrorism
- Fraudulent, deceptive, or constituting false advertising
5. Reporting Violations
If you become aware of any use of Malya services that violates this AUP, please report it immediately to trust@malya.io. We investigate all reports and will take appropriate action, which may include account suspension, termination, or reporting to law enforcement.
6. Enforcement
Malya reserves the right to investigate any suspected violation of this AUP. We may:
- Issue a warning and require remediation
- Suspend specific features or the entire account
- Terminate the account and cancel all services without refund
- Report conduct to law enforcement or regulatory authorities
- Pursue legal action to recover damages
